Gobi Terms of Service

Gobi is a simulated trading and educational practice tool. Everything in the Service is practice data. Please understand and agree that:

• All balances, orders, positions, fills, PnL, leaderboards, and account history are simulated practice data and use virtual money only.
• Gobi does not support real-money trading and does not place real orders in any market.
• Gobi does not support deposits, withdrawals, custody, KYC, brokerage, payments, or money transmission of any kind.
• Nothing in the Service has, represents, or converts to real-world monetary value, and virtual balances can never be redeemed, cashed out, or exchanged for anything of value.
• Gobi is not a broker-dealer, investment adviser, exchange, bank, or financial institution, and the Service is not, and must not be relied on as, investment, financial, legal, tax, or trading advice.
• Market data and educational content are provided for practice and learning only and may be delayed, incomplete, or inaccurate.

HEVM Wallet is a separate app from us for holding USDC on the HyperEVM network and sending it to other wallet addresses. Unlike the Gobi practice app, the balance in HEVM Wallet is real digital currency. If you use HEVM Wallet, these additional terms apply to it:

• HEVM Wallet is a self-custody wallet. Your USDC is held at your own wallet address on the HyperEVM network, not in an account we run. Your wallet key is created and secured in hardware enclaves run by Privy, our wallet infrastructure provider, and released only to your own signed-in session. Every transfer out requires your approval and a signature made with your key over the exact amount and recipient. We act as the operator: we pass the transfers you sign to the network and pay the network fee for them, and we cannot change a transfer or make one in your place.
• HEVM Wallet is not a bank, and your balance is not a bank deposit. It is not insured by the FDIC or any other deposit insurance scheme. USDC is issued by a third party and its value and availability are outside our control.
• Transfers on a public blockchain are final. If you send to the wrong address or the wrong network, the funds cannot be recovered by us or by anyone else. Check the destination on the review screen before you approve.
• You are responsible for your sign-in credentials and for any key you export. Anyone who holds your exported key can move your money. We cannot restore access to funds controlled by a key you have lost or exposed.
• You can export your key at any time and use the same address in any other wallet software, without us, as described in the recovery guide linked from the app. Deleting your account does not move your money and does not change anything on the public network; send or export first.
• We may set and change limits on transfer size and transfer frequency, may refuse to relay a transfer to an address that fails sanctions or fraud screening, and may pause the service to protect it. Network fees we cover today may become chargeable with notice.
• This version of HEVM Wallet does not offer trading, investment, exchange, lending, or advisory services, and nothing in it is financial, investment, legal, or tax advice. You are responsible for any taxes and for complying with the laws that apply to you where you live.
• You must be at least 18 years old to use HEVM Wallet, and you may not use it where doing so is prohibited by law or by sanctions that apply to you.
• Using HEVM Wallet involves risks that the Gobi practice app does not, including blockchain and smart-contract failures, network congestion, the unavailability of third-party providers, and the loss of a key. To the extent the Limitation Of Liability section below refers to practice data, that sentence does not apply to HEVM Wallet; the remaining limits apply to both apps to the maximum extent permitted by law.

You must be at least 13 years old to use the Service, or older if the age of majority or the minimum age required to use online services where you live is higher. If you are under the age of majority, you may only use the Service with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements and that you are able to enter into these Terms.

• You are responsible for activity that happens under your account and for keeping your login credentials secure.
• Provide accurate information and keep it up to date, and do not share, sell, or transfer your account.
• Notify us promptly at support@arcaos.io if you believe your account has been accessed without your permission.

When using the Service, you agree that you will not:

• Break the law or use the Service for any illegal, fraudulent, or harmful purpose.
• Post or send objectionable content, or harass, threaten, abuse, impersonate, or harm other people.
• Attempt to present the Service, virtual balances, or simulated results as real money, real trading, or a real financial product to deceive others.
• Solicit real-money transactions, run pump-and-dump or other financial scams, post spam, or advertise unrelated products or services.
• Probe, scrape, reverse engineer, overload, disrupt, or attempt to gain unauthorized access to the Service or its systems.
• Upload malware or interfere with the security, integrity, or normal operation of the Service.

Gobi includes social features such as profiles, direct messages, community posts and comments, and shared practice trade cards. Gobi has zero tolerance for objectionable user-generated content and abusive behavior. Objectionable content and conduct include, but are not limited to, hate speech, harassment, bullying, threats or incitement of violence, sexual content involving minors, other sexual or pornographic content, spam, impersonation, and any illegal content.

• You can report objectionable content using the report action available on any post, comment, message, or profile.
• You can block abusive users to stop further contact and hide their content from your experience.
• Reported content and reported users are reviewed, and content that violates these Terms or our Community Guidelines may be removed.
• Users who post objectionable content or behave abusively may be suspended or removed (ejected) from the Service.
• We act on reports of objectionable content and abusive users, and we aim to review and remove violating content and ejected users — often within 24 hours of a report.

These commitments reflect our standards for a safe community and are consistent with Apple App Store Guideline 1.2 for user-generated content. For the full list of expectations, see our Community Guidelines.

You are solely responsible for the content you post, send, or share through the Service, including profile details, messages, posts, comments, and shared practice trade cards. You represent that you have the rights to share what you post and that it does not violate these Terms, our Community Guidelines, or the law.

You retain ownership of your content. You grant Gobi a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your content as needed to operate, provide, and improve the Service. We may review, moderate, refuse, remove, or restrict any content at our discretion, particularly content that is objectionable or violates these Terms, but we are not obligated to monitor all content.

You may stop using the Service at any time and can delete your account from inside the app (Profile, then Delete account). We may suspend, restrict, or terminate your access to the Service, remove content, or eject users at any time, with or without notice, if we believe you have violated these Terms or our Community Guidelines, or to protect the Service, other users, or the public. Provisions that by their nature should survive termination will survive.

The Service is provided “as is” and “as available” for practice and educational purposes only, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Gobi does not warrant that the Service will be uninterrupted, secure, error-free, or accurate, and simulated results do not predict or represent real-world trading outcomes. Nothing in the Service is investment, financial, legal, or tax advice.

To the maximum extent permitted by law, Gobi and its affiliates, officers, employees, and providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service. Because the Gobi practice app does not involve real money, you acknowledge that you cannot suffer real financial trading losses or gains through it. HEVM Wallet holds real digital currency and is governed by the “HEVM Wallet” section above.

These Terms are governed by the laws of the jurisdiction in which Gobi is established, without regard to its conflict of laws principles. You and Gobi agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction for any dispute arising out of or relating to these Terms or the Service, except where prohibited by applicable law.

We may update these Terms as Gobi changes. If we make material changes, we will update the date above and provide additional notice when appropriate. Your continued use of the Service after changes take effect means you accept the updated Terms.

These Terms work together with our Community Guidelines and our Privacy Policy, which are incorporated into these Terms by reference.
